I agree, Gary, that this was a case of "innocent passage" as defined by international law.
It was also, however, a case of poor judgment on the part of the officer in command due, probably, to a lack of navigational and political situational awareness. He did not realize that he had entered Iranian waters, nor did he
assess the geopolitical risks involved. One cannot depend on international law for protection when dealing with a state such as Iran, which so frequently flouts it.
SecState's inglorious expression of gratitude to Iran was motivated by politics, not international law. This episode occurred as the Iran nuclear deal was being concluded. But that's another topic for another forum.

As I learned in my "International law" course and at the the JAG school, even warships have the "right of innocent passage" through the territorial seas of another country. The navy ships were in "innocent passage" so it was a violation of UNCLOS to take the sailors hostage. Our Secretary of State shouldn't not have thanked Iran for violating the law.
