Did the captain of the Fitzgerald breach the Articles of War (or whatever the relevant document is called)?
Admiral John Byng breached the Articles and suffered the ultimate penalty on 14th March 1757. It has been suggested that this is why the Royal Navy was so successful in subsequent years.
