He's hardly getting a bum rap. The NTSB stated the direct causative facts.
Frank raises an excellent point about the contributory nature of the deferred maintenance. Who would know best about that? Would the deferred maintenance be within the knowledge base of the captain? If it was, then he knowingly took an 'unready' vessel into harms way.
I see the captain as having multiple errors in judgment. First for taking any vessel into those sea states. Secondly, for knowingly taking a vessel with serious maintenance issues into those seas. Thirdly, for taking an inexperienced crew into those sea states.
That's not a 'bum rap' at all.
